Welcome to the cabi family of websites (collectively, the “Website”). cabi, LLC (”us,” “we,” or “cabi”) is committed to respecting the privacy rights of its customers, visitors, and other users of the Website. We created this Privacy Policy (this “Policy”) to give you confidence as you visit and use the Website, and to demonstrate our commitment to fair information practices and the protection of privacy.

This Policy describes the types of information we may collect from you or from others or that you may provide when you visit our Website and our practices for collecting, using, maintaining, protecting, and disclosing that information. The Policy also applies to all services that we offer, including via e-mail or text message inquiries or other services that we offer through our Website (the “Services”).
This Policy is only applicable to the Website and the Services, and not to any other website(s) that you may be able to access from the Website, or services you may use there, each of which may have data collection and use practices and policies that differ materially from this Policy.
Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. 1.3. Notice Concerning Children
While our Website is a general audience site, the Website is not intended for children under the age of 13 and we do not direct any of our content specifically at children under the age of 13. We do not knowingly collect Personal Information (as defined below) from children under the age of 13. If you are under the age of 13, do not use or provide any information on this Website or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features on the Website, or provide any information about yourself to us, including your name, address, telephone number, e-mail address, or any screen name or user name you may use. If we learn we have collected or received Personal Information (as defined below) from a child under 13 without verification of parental consent, we will delete that information.
California residents under 16 years of age may have additional rights regarding the collection and sale of their Personal Information (as defined below). Please see “Consumer’s Rights Under The California Consumer Privacy Act” below for more information.
2. INFORMATION COLLECTION PRACTICES
2.1. What Basic Information Do We Collect?
In operating the Website, we may include registrations, online surveys, and other online forms that ask users to provide their names, addresses, phone numbers, e-mail addresses and other contact information, date of birth, bank information of Stylists, credit card information for purchases, as well as other user profile information, including without limitation, gender, education, occupation and images and videos you submit. We may also collect information of other people that cabi Stylists, cabi customers or Hostesses provide to us, including (without limitation) the names, email addresses, and phone numbers of “Guests” or people that have been invited or have agreed to be invited to cabi events by a Hostess or Stylist. We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal information”). In particular, we have collected the following categories of Personal Information from consumers within the last twelve (12) months:

2.2. What Additional Information Do We Collect?
(a) Automatic Collection. Our servers automatically recognize visitors’ domain names and IP addresses (the number assigned to computers on the Internet). No personal information about you is revealed in this process. However, if you log into the Website, then we may automatically collect Personal Information about you. The Website may also gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving the services we offer.
(b) Cookies. From time to time, we may use the standard “cookies” feature of major browser applications that allows us to store a small piece of data on your computer about your visit to our Website. We do not set any personally identifiable information in cookies, nor do we employ any data capture mechanisms on our Website other than cookies. Cookies help us learn which areas of our site are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at our Website may be diminished and some features may not work as they were intended.
2.3. How we collect your Information?
If you are a cabi customer, Guest or a Hostess, your personal data may be provided to us by the cabi Stylist who took your order or who organized or attended a cabi event that you hosted or attended. This information may have been gathered by importing the Stylists or Hostesses personal email contacts list. For the convenience of our Stylists and customers, we use an online point of sale to process sales transactions. This feature avoids the need to re-enter transaction information in successive transactions, and helps foster the long term Stylist-to-customer relationship we aim for. The online point of sale process will also provide us with your personal data, but not your financial information – i.e., the method you used for payment in the transaction. We also receive personal data that you text to us. We may collect the personal data provided to us as described above. This information will be stored in a safe and secure manner and only used by cabi or a cabi Stylist for the sole purpose of contacting you or Guests as specified herein.
This privacy statement also describes how cabi collects and uses the information you provide in your account or that Hostesses or Stylist provide about Guests via the cabi “Online Hostess Planner” application. It also describes the choices available to you regarding our use of your information and how you can access and update this information. However, this statement only describes the information that cabi actually collects, and Stylists may collect information outside of the Hostess Planner.
We collect the following personal information from your personal account:

· Contacts’ telephones
· Contacts’ postal address
· Contacts’ birthday
· Stylist Image
We may collect the following information from Guests provided to us by Stylist or Hostess via the Online Hostess Planner, including:

· Guests’ telephones
· Guests’ shipping addresses
3. USE AND SHARING OF INFORMATION
3.1. What Do We Do With Collected Information?
(a) Personal Information. We will not share your personal information with any third parties without your consent, except as necessary to provide you with the services offered by us or to comply with the law. We may use your personal information to verify your identity or to follow up with transactions initiated on the Website. Our use of an online point of sale process may make your personal information available to our Stylists for viewing as customer names are entered and the point of sale begins to recognize those names to automatically populate the subject sales transaction data. We may use your contact information to: (i) inform you of any changes to the Website, (ii) populate your personal email contact data into your Stylist’s cabi customer management tool, (iii) create show invites from your Stylist’s show calendar for the imported contacts, and (iv) send show confirmation emails, show cancellation emails, show update emails or show reminder emails to the contacts imported from personal email contacts. We may also send you additional information about cabi, or to offer you other products, programs or services that we believe may be of interest to you. Cabi may use this information to send you commercial and promotions emails (“Brand Emails”). Stylist you have connected with may also use your contact information to send you commercial and promotional emails, as well as invites, reminders and other event related information via email (“Stylist Communications”). On each Brand Email and each Stylist Communication email, there will be an unsubscribe link that will allow you to “Out-opt” or unsubscribe from Brand Emails and/or Stylist Communications at any time. Cabi or Stylists may still send you other types of transactional and relationship email communications even if you opt out. If you are a Stylist and give your permission during the account registration process, we may share your contact information on the Website. We don’t give personal information to any partners (except for possible incidental disclosure to Stylists using online point of sale process described above). If you choose to post information on the Website in a public forum, your name, location and comment (all as entered by you) will be displayed to all users of the Website to facilitate interaction among users. General users’ email addresses are never revealed to other users (except for possible incidental disclosure to Stylists using online point of sale process described above); provided, however, Stylists have the option of revealing their email address and phone number on the Website.
We may use the contact information of Guests that are collected via the Online Hostess Planner to send Guests invitations to cabi events via email and to send Guests reminders about invitations to events or other event-specific information via email. We may also send Guests Brand Emails, and Stylists that Guests have connected with may receive Stylist Communications from them. Guests can “Opt-out” from Brand Emails and/or Stylist Communications at any time by clicking on the unsubscribe link in the emails Guests receive. However, Guests may still receive transactional and relationship email communications even if they opt-out.
(b) Anonymous Information. We use anonymous information to analyze our Website traffic, but we do not examine this information for individually identifying information. In addition, we may use anonymous IP addresses to help diagnose problems with our server, to administer our site, or to display the content according to your preferences. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.
(c) Use of Cookies. We may use cookies to deliver content specific to your interests, to save your password so you don’t have to re-enter it each time you visit our site, or for other purposes such as (a) cookie-based advertising, and (b) to track purchase behaviors for the purpose of attribution.
(d) Disclosure of Personal Information. We may volitionally disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (i) conform to the edicts of the law or comply with legal process served on cabi or its affiliates, (ii) protect and defend the rights or property of cabi or the users of the Website, or (iii) act under exigent circumstances to protect the safety of the public or users of the Website.
(e) We will only use the mobile phone number you provide to transmit your text messages, send you text message communications that you have consented to, and respond to you, if necessary. This includes sharing information with our program partners, message content providers, phone companies, and vendors who assist us in the delivery of mobile messages. EXCEPT AS SET FORTH IN THIS SECTION, WE DO NOT SELL, RENT, LOAN, TRADE, LEASE OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED TO ANY THIRD PARTY. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property.
(f) Sale of Assets. In order to accommodate changes in our business, we may sell or buy portions of our company or other companies or assets, including the information collected through the Website. If cabi or substantially all of its assets are acquired, customer information will be one of the assets transferred to the acquirer.
(g) Access to Information / Opting-Out. If you have opted to receive email from us, you may unsubscribe at any time by using an “Unsubscribe” link at the bottom of an email. 4. SECURITY
The Website has security measures in place to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.
5. SITE AREAS BEYOND OUR CONTROL
5.1. Public Forums
The Website includes interactive forums for the exchange of information, ideas and opinions. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose personal information.
5.2. Third Party Websites
The Web Site may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.
6. CONSUMER’S RIGHTS UNDER THE CALIFORNIA CONSUMER PRIVACY ACT (“CCPA”)
If you are a California resident, California law may provide you with additional rights regarding our use of your Personal Information. California Privacy laws require that we provide California residents information about how we use their personal information, whether collected online or offline, and this section (along with the rest of the Policy) is intended to satisfy that requirement.
6.1. Right to Know
You have the right to know and see what data we have collected about you over the past 12 months, including:
· The categories of Personal Information we have collected about you;
· The categories of sources from which the Personal Information is collected;
· The business or commercial purpose for collecting your Personal Information;
· The categories of third parties with whom we have shared your Personal Information; and
· The specific pieces of Personal Information we have collected about you.

6.2 Right to Delete
You have the right to request that we delete the Personal Information we have collected from you (and direct our service providers to do the same). There are a number of exceptions, however, that include, but are not limited to, when the information is necessary for us or a third party to do any of the following:
· Complete your transaction;
· Provide you a good or service;
· Perform a contract between us and you;
· Protect your security and prosecute those responsible for breaching it;
· Fix our system in the case of a bug;
· Protect the free speech rights of you or other users;
· Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);
· Engage in public or peer-reviewed scientific, historical, or statistical research in the public interests that adheres to all other applicable ethics and privacy laws;
· Comply with a legal obligation; or
· Make other internal and lawful uses of the information that are compatible with the context in which you provided it.

6.3. How to Make a CCPA Request

6.4. Opting-Out to the Sale of Personal Information
The CCPA gives residents of the state of California the right to prevent businesses from selling their Personal Information. We do not sell your Personal Information unless such sale is in connection with the sale of us or of all of our assets. However, if you would like to record your preference that we do not sell your data in the future, please email us at privacy@cabiexperience.com. We do not sell personal information about California residents who we know are younger than 16 unless such sale is in connection with the sale of us or of all of our assets.
6.5. Non-Discrimination; Disclosure of Incentives
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
· Deny you goods or services;
· Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
· Provide you a different level or quality of goods or services; or
· Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods and services.
If businesses offer any financial incentives for the collection, sale or deletion of California residents’ Personal Information, California residents have the right to be notified of any financial incentive offer and their material terms, the right not to be included in such offers without prior informed opt-in consent, and the right to be able to opt-out of such offers at any time. Businesses may not offer unjust, unreasonable, coercive or usurious financial incentives. We do not offer any financial incentives at this time.
